Bilaspur: The High Court has directed the state government to dissolve the nominated council of the newly formed Marwahi Nagar Panchayat. The court has ordered the state government to form a new council within a month from the elected representatives of Marwahi, Kumhari and Lohari Gram Panchayats. Regarding the matter, Marwahi Sarpanch Priyadarshini Naharel had filed a petition in the High Court making 11 people parties. After hearing on which Justice Parth Pratim Sahu has issued an order.
In fact, the state government had formed Marwahi Nagar Panchayat by combining Marwahi, Kumhari and Lohari Gram Panchayats, and by publishing a notification in the gazette, BJP leader Kishan Thakur was made the president of the newly formed Marwahi Nagar Panchayat, along with 8 other Nagar Panchayat Council members were nominated, but the Sarpanches of these three Gram Panchayats were kept out of this process. On which the former Sarpanch of Marwahi Gram Panchayat Priyadarshini Naharel filed a petition in the High Court challenging the formation of the Nagar Panchayat. In the petition, she made a total of 11 people parties, including the Secretary of the Urban Administration Department, the Collector of Gaurela Pendra Marwahi District, the newly appointed Chairman and eight councilors.
Justice Parth Pritam Sahu’s bench completed the hearing of the case on July 16, after which the decision was reserved. The single bench of the High Court has issued an order saying that there has been an error in the process of formation of the committee. Due to which the notification issued on June 27 is canceled. Also, the court has given instructions to form a new council within a month. The current committee will continue to function until the new committee is formed.
