Law and Justice: Why are courts unable to provide justice to male victims of sexual assault?
The Delhi High Court has sought a response from the Central Government to provide clarification on the reasons for excluding cases related to homosexual consent from the category of crime.
The bench of Acting Chief Justice Manmohan and Justice Tushar Gedela remarked that there is no clear provision on this in the Indian Judicial Code (BNS). This means that if there is no mention of it in the BNS, does it come under the category of crime?
Although our society sees sexual assault as predominantly a crime against women, men are sexually assaulted too. Stereotypes that tie masculinity to sex can make it difficult to separate the sex act from the crime of sexual assault. Sexual assault is equally devastating to men and women.
