Judiciary: Former SCBA president wrote a letter to PM Modi, expressed concern over the statement of BJP MP Nishikant Dubey

Judiciary: Former SCBA president Adish C. Aggarwal wrote a letter to PM Modi and called BJP MP Nishikant Dubey’s comments on the Supreme Court worrying and said that such comments can weaken the public’s trust in the judiciary. He termed the Supreme Court’s decisions as constitutional.

Former President of Supreme Court Bar Association (SCBA) Adish C. Agarwal has written a letter to Prime Minister Narendra Modi. In the letter, he has expressed deep concern over the comment of Bharatiya Janata Party (BJP) MP Nishikant Dubey on the Supreme Court. Nishikant Dubey had allegedly said that if the Supreme Court has to make laws then the Parliament should be closed. The legal community has reacted sharply to his statement.

Senior advocate Agarwal termed this comment as ‘shocking’ and said that such statements by the leaders of the ruling party can destroy the trust of the people in the judiciary. Referring to the landmark decisions of the Supreme Court in 2023 in the case of ‘State of Punjab vs Principal Secretary to the Governor of Punjab’ and ‘State of Tamil Nadu vs Governor of Tamil Nadu’, Agarwal clarified that there is no fixed time limit in Articles 200 and 201 of the Constitution, so the Supreme Court set a logical time limit of three months for the President and the Governor to take a decision on the bills and this decision was taken within the limits of the Constitution.

He said, this decision is not an example of exceeding the limits of the judiciary. The court did not give any order to either the President or the Governor, but only said that if there is a delay of more than three months, then their approval will be considered in it. Agarwal said that if the government disagrees with the time limit set by the court, then it has the right to make laws and amend the existing provisions. There may be disagreements over the timeline, but the right way to do this is not public criticism, but amendment of the law, he wrote.

Aggarwal praised the government for the respect shown to the judiciary so far and urged Prime Minister Modi to stop his party leaders from making such public comments that undermine the balance of powers established by the Constitution and harm the cordial relations between the judiciary and the executive.

On the other hand, Congress leader BK Hariprasad targeted BJP chief JP Nadda’s tweet on MPs Nishikant Dubey and Dinesh Sharma. He said, this is the new fashion of BJP. Their radical elements will speak against the Constitution, the tricolor and secularism and they will quietly say that we distance ourselves from this statement. PM Modi should apologize to the country for Nishikant Dubey’s statement.
