New Delhi: All India Students’ Association (AISA) president Neha Bora challenges a peace-bond notice before the Delhi High Court, arguing through her counsel that citizens do not require permission to hoist the national flag. Justice Subramonium Prasad heard the matter on Thursday and reserved the verdict on her plea against the notice seeking a ₹10,000 personal bond with one surety, with the order scheduled for Friday, October 23.

Counsel Questions Basis of Notice

Senior advocate Gopal Sankaranarayanan, appearing for Bora, questioned the notice’s reference to hoisting the national flag without valid permission.

“Maybe they need some instruction on law that we don’t need permission to hoist the national flag,” he submitted.

He also questioned whether the Special Executive Magistrate had independently assessed the grounds for initiating proceedings. Bora’s petition seeks the quashing of the notice and protection against coercive action. These submissions represent her case before the court, which has yet to deliver its verdict.

Bora Denies Role in Connaught Place Protest Call

Bora also denied involvement in CJP’s October 16 protest call at Connaught Place.

Her challenge concerns preventive proceedings following the October 16 demonstrations, with the notice requiring her to explain why she should not furnish security to maintain peace.

Delhi Police Defends Proceedings

Additional Solicitor General Chetan Sharma, representing Delhi Police, objected to the maintainability of the petition.

Police maintained that the magistrate had examined the available material before issuing the notice. Bora’s counsel disputed the adequacy of that examination and questioned compliance with the legal requirements for initiating proceedings.

Court Reserves Verdict

After hearing both sides, Justice Prasad reserved the verdict. The order is scheduled to be pronounced at 6 pm on Friday.

The proceedings concern an October 17 notice issued by the Special Executive Magistrate seeking a personal bond and surety during an inquiry into an apprehended breach of peace. The court’s decision will determine the outcome of Bora’s challenge to that notice.
