SC: Relief to Tahir Hussain, accused of Delhi riots, Supreme Court grants custody parole, he will be able to campaign for elections

Tahir Hussain had said in his appeal that ‘he will not even go to his house during the election campaign and will stay in the hotel only.’ Tahir Hussain’s house is located in Mustafabad area, where the riots took place.

New Delhi : The Supreme Court has granted relief to Tahir Hussain, accused of the 2020 Delhi riots and former councilor, and has approved custody parole. After this, Tahir Hussain has been allowed to campaign in police custody. Tahir Hussain is contesting the assembly elections from Delhi’s Mustafabad seat on an AIMIM party ticket. Tahir Hussain had earlier filed a petition in the Supreme Court seeking bail for election campaign, but it was not approved. Now he had sought permission from the Supreme Court to allow him to campaign in police custody. Which has been approved by the Supreme Court.

Tahir Hussain will have to bear the entire expense
The Supreme Court bench, in its order at 2 pm, ordered custody parole to Tahir Hussain. The Supreme Court has granted custody parole to Tahir Hussain from January 29 to February 3. During this period, whatever expenses will be incurred on his custody, Tahir Hussain will have to bear it. This includes the expenses of Delhi Police employees, jail vehicle and escort vehicle. The Supreme Court has also ordered Tahir Hussain to submit a bond of Rs 2 lakh for 12 hours. It is worth mentioning that several cases are going on against Tahir Hussain. He had earlier also demanded bail for election campaign, but a two-judge bench of the Supreme Court gave different orders on that petition. After which the petition was sent to a larger bench.

Tahir Hussain’s lawyer gave these arguments

During the hearing, senior advocate Siddharth Agarwal, who appeared in the court on behalf of Tahir Hussain, told the bench of Justice Vikram Nath, Justice Sanjay Karol and Justice Sandeep Mehta that ‘only four-five days are left in the election campaign, so he should be allowed to campaign in police custody.’ Tahir Hussain said in his appeal that ‘he will not even go to his house during the election campaign and will stay in a hotel.’ Tahir Hussain’s house is located in Mustafabad area, where the riots took place.

Additional Solicitor General SV Raju opposed Tahir Hussain’s appeal and argued that if he is given relief, then everyone will start filing nominations for elections from jail. After hearing the argument, the court asked SV Raju to provide information about the expenses and arrangements made for Tahir Hussain’s election campaign while in police custody.
