New Delhi : Court bail out Accused after seeing WhatsApp Chat, A unique decision of a court in the country’s capital Delhi has become the center of discussion. Here the court grants the bail to the accused on the basis of WhatsApp chat. Actually, a Delhi court granted anticipatory bail with conditions to the brother-in-law accused of raping his sister-in-law. The court said that the WhatsApp chat between brother-in-law and sister-in-law shows that the relationship between them was very good. Therefore the brother-in-law is being granted a conditional bail .
Vikaspuri Police Station (Delhi Police) had registered an FIR against the accused brother-in-law under the penal provisions of rape, unnatural sex, atrocities on a married woman, criminal breach of trust and common intention. The case was being heard by Additional Sessions Judge Vinod Kumar Meena on the anticipatory bail plea of the accused brother-in-law.
The court said, ‘After hearing the arguments of both the sides and looking at the bail plea, reply to the bail plea and the attached documents, it is found that the allegations are of serious nature. However, the WhatsApp chat shows that the accused and the complainant had a good relationship. It said that although the complainant had made allegations of molestation in September and November 2022, it is surprising that she did not lodge a complaint.
The court said, no message or e-mail has been sent to any member of the family regarding this incident. It is also observed that there are marital disputes going on between the complainant and the brother of the accused.
The court granted anticipatory bail to the accused brother-in-law on the condition that the accused will not threaten the complainant sister in law ( Sali ) or her family members and he will join the investigation whenever required. The court also said that in case of arrest, the accused shall be released on bail on furnishing a personal bond and a bail bond of Rs 25,000 (each).
