Who is the caretaker CM…
When the CM of the state leaves his post under any circumstances (losing the election, no confidence or resignation), then the Governor has the right to ask him to take over the responsibility of the caretaker CM post till the appointment of a new Chief Minister and the formation of a permanent government. As the name ‘caretaker’ itself makes it clear that any Chief Minister remains the CM of the state after his resignation until the new Chief Minister takes oath. That is, the leader who takes over the responsibility till a permanent CM is found is called the caretaker CM.
This rule is not only applicable during resignation, but also at the time of elections. If the term of a government is over and for some reason there is some time left in the election dates, in such a situation the Governor instructs the Chief Minister and the President instructs the Prime Minister to work as caretaker till the new government is formed.
How different is the role of the caretaker Chief Minister from the CM
There is a lot of difference between the role of the CM and the caretaker CM. The Chief Minister has the right to take decisions, announce new schemes and new appointments. But the powers of the acting Chief Minister are limited. He cannot start any new scheme. It is his responsibility to maintain law and order. Therefore, the acting CM can give instructions on legal matters. He can also monitor the schemes already running. However, after the oath of the new Chief Minister, the responsibility of the acting CM ends. Even if President’s rule is imposed in the state, the powers of the acting Chief Minister end and the command comes directly in the hands of the Governor.
Acting CM is considered necessary
The acting Chief Minister is made so that order is maintained in the state. However, after the swearing-in of the new CM, the power and authority of the acting Chief Minister ends. Apart from this, if President’s rule is imposed in any state after this, then the role of the acting Chief Minister ends. The command of the state reaches the hands of the Governor.
Let us tell you that in the Delhi Assembly elections, out of 70 seats, Aam Aadmi Party got only 22 seats. After which Atishi had to leave the CM post. Meanwhile, amid the long-running violence in Manipur, CM Biren Singh resigned on Sunday. The name of the new CM has not been announced yet in both the places.
