Who is Kavita Sarkar, who will fight the case of Kolkata doctor rape murder case accused Sanjay Roy

Who is Kavita Sarkar

Kavita Sarkar is a law graduate from Hooghly Mohsin College. She started her career from Alipore Court where she used to work on civil cases. In February 2023, she was transferred to criminal law as a SALSA lawyer. After this, she is working in Sealdah Court in June 2023. She is the only standing lawyer of the State Legal Authority in Sealdah Court. That is why this case has been given to her. Today she can seek permission to fight the case in court.

Why did she decide to fight this case?

Kavita Sarkar accepted this case because she believes that justice should be given only after hearing in the court, no decision should be given in advance. She says that every person has the right to a fair hearing, even if he is an accused. Kabita Sarkar has sought the support of her senior Sourav Banerjee during this case. Kabita Sarkar is against the death penalty and believes that life imprisonment should be the biggest punishment. She believes that criminals should be given a chance to repent for their actions.

Support for fair trial

Kavita Sarkar has said that she believes in the decision given after the legal process and not in pre-trial judgment. Apart from this, she has also emphasized on the right of every person including the accused to a fair trial. She has requested to keep her senior Sourav Banerjee with her during the case. She has said that it is my job to represent the accused who do not get lawyers in criminal cases.

Kolkata RG Kar Hospital case

On August 9, a 31-year-old PG graduate trainee doctor was raped and murdered at Kolkata’s RG Kar Medical College. This has caused outrage in the whole country. The attacker Sanjay Roy, who was an employee of the hospital, carried out the incident after seeing the victim alone in the seminar hall. Kabita Sarkar, like others, says she wants justice for the victim doctor’s daughter, according to an interview with The Times of India. But for them, justice is after the court hearing, and not before. He says that everyone in this country has the right to a fair trial, regardless of the accused. Regarding the ongoing women’s movement and protests across the country, Kabita Sarkar said that I am doing my job. My job is to represent accused persons who do not have access to lawyers in criminal cases.

Lawyer Sahiba said – this is not the only case. I have done this before. I have paid the bail bonds from my salary. If the court asks me to represent the accused, I will do the same. I will appeal to the court to allow my senior counsel Saurabh Banerjee to accompany me when I present Sanjay Roy’s case.

‘I do not support demand for death penalty’

When the Kabita government was asked about the death penalty for Sanjay Roy, it said that it does not personally support the demand for death penalty. Life imprisonment is the highest punishment for them. He has visited prisons and the Presidency Women’s Reformatory. He said that any person should be given an opportunity to look inside his life i.e. introspect and be found guilty of the crime. He said that one should always remember that the law says that anyone is innocent until proven guilty.
