Lucknow. Former BJP MP Maneka Gandhi has received a big setback from the Lucknow bench of Allahabad High Court. The Lucknow bench has rejected the petition filed by Maneka Gandhi against the election of SP MP Rambhual Nishad from Sultanpur. The court has considered this petition as a violation of the time limit and against Section 81 and 86 of the Representation of the People Act 1951.
Let us inform you that former BJP MP Maneka Gandhi had filed a petition saying that a total of 12 criminal cases are pending against Rambhual Nishad. But only 8 cases were mentioned in the election affidavit. It was also said that not disclosing or hiding criminal background cases in the affidavit is included in corrupt conduct. But the High Court rejected Maneka Gandhi’s petition saying that her petition was barred by limitation.
Why was the petition rejected?
Section 81 of the Representation of the People Act, 1951 states that a petition challenging any election must be filed within 45 days of the declaration of the election result.
